These Terms and Conditions (“Terms”) govern your use of communitysolar.org and your interactions with online forms and other website services provided in connection with Sisters Community Solar.
By using this website or submitting information through it, you agree to these Terms.
1. About Sisters Community Solar
Sisters Community Solar is a community solar project being developed on land owned by the Sisters of the Holy Family in New Orleans. The project is operated through Dwyer Rd Community Solar, LLC and is being developed in partnership with organizations including Together New Orleans.
Sisters Community Solar participates in the Community Solar Program regulated by the New Orleans City Council and works with Entergy New Orleans to enroll eligible subscribers and provide community solar bill credits.
Sisters Community Solar is not Entergy New Orleans and does not provide your retail electric service. Entergy New Orleans remains your electric utility.
2. Website Purpose
Communitysolar.org provides information about Sisters Community Solar and may allow people to:
Join the Sisters Community Solar Priority List;
Request information;
Receive project updates;
Determine whether they may be eligible to participate;
Begin or complete portions of the subscriber enrollment process; and
Communicate with Sisters Community Solar and its representatives.
Information on this website is provided for general informational and program-administration purposes. It does not replace the applicable Community Solar Program rules, Entergy New Orleans requirements, or any subscriber agreement that applies to your participation.
3. The Priority List Is Not a Subscription
Submitting the Sisters Community Solar Priority List form expresses your interest in the project and allows us to contact you about future enrollment opportunities.
Joining the Priority List does not:
Enroll you as a Sisters Community Solar subscriber;
Create a community solar subscription;
Guarantee that you will receive a subscription;
Guarantee a particular subscription size or allocation;
Guarantee that you meet program eligibility requirements; or
Guarantee any particular amount of electricity-bill savings.
Additional information, verification, authorization, and agreements may be required before you become a subscriber.
4. Email and Text Communications
If you provide your email address, Sisters Community Solar and organizations or service providers working on its behalf may contact you by email about Sisters Community Solar, including your Priority List status, enrollment opportunities, eligibility, enrollment reminders, requests for information, project updates, community events, and other project-related information.
If you separately opt in to receive text messages, you authorize Sisters Community Solar and organizations or service providers working on its behalf to send text messages to the mobile number you provide. Text messages may concern your Priority List status, eligibility, enrollment opportunities and reminders, requests for information needed to complete enrollment, project updates, community events, and other Sisters Community Solar information.
Message frequency may vary. Message and data rates may apply. Reply HELP for help or STOP to opt out of text messages at any time.
Consent to receive text messages is not required to join the Priority List or subscribe to Sisters Community Solar.
We will honor requests to opt out of text messages. If you later become a subscriber, we may continue to provide transactional, account-related, regulatory, or legally required communications through email, mail, telephone calls, or other permitted means when reasonably necessary to administer your subscription.
5. Subscriber Eligibility
Actual participation in Sisters Community Solar is subject to eligibility requirements established by the New Orleans City Council’s Community Solar Program, Entergy New Orleans requirements, and the applicable subscriber agreement.
Among other requirements, a subscriber generally must have an eligible Entergy New Orleans electric account. Subscription amounts may also be limited based on the customer’s electricity usage and other program rules.
Sisters Community Solar and Entergy New Orleans may need to verify information before a subscription becomes effective.
Program requirements may change. If information on communitysolar.org conflicts with a controlling New Orleans City Council rule, Entergy New Orleans tariff or requirement, or your applicable subscriber agreement, the controlling program document or subscriber agreement will govern to the extent of the conflict.
6. Subscriber Agreement
These Website Terms are not a community solar subscriber agreement.
If you choose to become a Sisters Community Solar subscriber, you will be provided with or asked to accept separate terms governing your subscription. Those terms may address matters including:
Your subscription amount;
Subscription pricing or charges;
Calculation and application of benefits;
Subscription duration;
Enrollment and effective dates;
Changing or transferring a subscription;
Cancellation or termination;
Rights relating to renewable energy attributes;
Required authorizations; and
Other rights and obligations associated with your subscription.
If there is a conflict between these Website Terms and your subscriber agreement concerning your actual subscription, the subscriber agreement will control.
7. Utility Account Information and Authorization
The Community Solar Program requires Sisters Community Solar to coordinate with Entergy New Orleans.
If you proceed with enrollment, you may be asked to provide information such as your name, Entergy New Orleans account number, service address, electricity usage information, subscription amount, and eligibility information.
You agree that information you submit will be accurate to the best of your knowledge and that you have authority to provide information concerning the utility account involved.
Where required, you will also be asked to provide appropriate authorization for Sisters Community Solar, its subscription administrator, and Entergy New Orleans to exchange information necessary to determine eligibility, complete enrollment, administer your subscription, and apply community solar credits.
Acceptance of these Website Terms alone does not replace any specific customer authorization, enrollment consent, or subscriber agreement required by Entergy New Orleans or the Community Solar Program.
8. Electricity Bill Credits and Savings
Community solar allows eligible subscribers to receive credits associated with electricity generated by the community solar facility without installing solar panels on their own homes.
However, actual bill credits and savings may vary.
They may depend on factors including:
Electricity generated by the Sisters Community Solar facility;
The size or allocation of your subscription;
Entergy New Orleans rates and tariffs;
Community Solar Program rules;
Your electricity usage;
Subscription pricing or charges;
System outages, maintenance, weather, and other operating conditions; and
Future regulatory or utility changes.
Any examples, calculators, projections, estimates, or statements concerning expected savings on communitysolar.org or in Sisters Community Solar outreach materials are intended to help explain the program and are not guarantees of future savings unless expressly stated otherwise in a binding subscriber agreement.
9. Regulatory and Program Changes
Sisters Community Solar operates within a regulated utility program.
The New Orleans City Council, Entergy New Orleans, or other authorities may change rules, tariffs, credit calculations, eligibility requirements, billing procedures, technical requirements, or other aspects of the Community Solar Program.
Sisters Community Solar may update its website, enrollment procedures, subscription offerings, or other practices in response to those changes.
10. Accuracy of Information You Provide
You agree to provide accurate, current, and complete information when using Sisters Community Solar forms or enrollment services.
You should not submit another person’s Entergy New Orleans account information unless you have authority to do so.
You are responsible for notifying Sisters Community Solar or the applicable subscription administrator if information relevant to your enrollment or subscription changes.
11. Privacy
Our collection and use of personal information is governed by the Sisters Community Solar Privacy Policy.
By submitting information through communitysolar.org, you acknowledge that your information may be collected, used, and disclosed as described in that policy.
Subscriber information may need to be provided to Entergy New Orleans, the New Orleans City Council or its regulatory staff, our subscription administrator, and service providers as necessary to administer the Community Solar Program and your subscription.
12. Acceptable Use
You may use communitysolar.org only for lawful purposes.
You may not:
Attempt to gain unauthorized access to the website or its systems;
Interfere with the website’s operation or security;
Submit false, fraudulent, or misleading information;
Use another person’s identity or utility account information without authorization;
Introduce malicious software or code;
Use automated systems in a manner that materially interferes with the website; or
Use website content in a way that violates applicable law or the rights of others.
13. Website Content and Intellectual Property
Unless otherwise indicated, content on communitysolar.org—including text, graphics, photographs, logos, designs, videos, and other materials—is owned by or licensed to Sisters Community Solar, Dwyer Rd Community Solar, LLC, its project partners, or the respective rights holder.
You may view, download, print, and share website materials for personal, educational, community outreach, or other noncommercial purposes, provided that you do not materially alter the content or misrepresent its source.
Other uses may require permission from the applicable rights holder.
14. Third-Party Websites and Services
Communitysolar.org may link to websites or services operated by Entergy New Orleans, Together New Orleans, government agencies, community partners, service providers, or other third parties.
We provide these links for convenience and information. We do not control third-party websites and are not responsible for their content, availability, security, terms, or privacy practices.
15. Website Availability
We work to keep communitysolar.org accurate, secure, and available, but we cannot guarantee that the website will always be available or error-free.
We may modify, suspend, or discontinue website features when reasonably necessary for maintenance, security, program changes, or other operational reasons.
If the website is unavailable, your rights and obligations under an existing subscriber agreement are not automatically affected.
16. Disclaimer
To the extent permitted by law, communitysolar.org and its content are provided on an “as is” and “as available” basis.
We make reasonable efforts to provide accurate and current information, but we do not warrant that every statement on the website will always be complete, current, or error-free.
Nothing on this website constitutes legal, tax, financial, or utility advice.
Nothing in these Terms limits any warranty, right, remedy, or protection that cannot lawfully be limited or waived.
17. Limitation of Liability
To the extent permitted by applicable law, Sisters Community Solar, Dwyer Rd Community Solar, LLC, and their respective project partners, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from your use of or inability to use communitysolar.org.
This limitation does not apply where liability cannot lawfully be excluded or limited.
Nothing in these Website Terms is intended to limit rights or remedies that you may have under a separate subscriber agreement, applicable utility rules or tariffs, or applicable law.
18. Changes to These Terms
We may update these Terms from time to time to reflect changes to communitysolar.org, Sisters Community Solar, the Community Solar Program, our services, or applicable law.
The updated Terms will be posted on communitysolar.org with a revised effective date.
Changes to these Website Terms do not by themselves amend an existing subscriber agreement unless that agreement expressly provides otherwise.
19. Governing Law
These Website Terms are governed by the laws of the State of Louisiana, without regard to conflict-of-law principles.
To the extent a dispute concerning these Website Terms may properly be brought in court, applicable state and federal courts located in Orleans Parish, Louisiana will have jurisdiction, subject to any rights or procedures that cannot lawfully be waived.
20. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
